file-copying behavior? It knows nothing of the help index file - it just

Matt,

I had the same problem until I reindexed each time. That's why I posted this link (http://outerlevel.com/blog/2006/12/21/ automatically-index-your-apple-help-book-with-xcode/) to automate it. For some reason, just touching the help html isn't enough. You have to manually or automatically rebuild the index each time.

If the help is added as just a folder reference, it's probably the modification datetime on the help folder itself; perhaps rebuilding the index is touching that timestamp.
