It would depend on the national laws of the country where you
operate (create / distribute your software), but the general answer
would certainly be that it's not OK. That said, and as you've
probably found, this is still not uncommon - at least among
freeware / shareware developers.
Well, in all countries that signed the Geneva convention, copyright
explicitly forbids copying art (including computer graphics). You can
recreate equivalent art to be safe. However, I haven't heard of Apple
suing anyone who stole a graphic from one of their apps to use in
their own Mac app. But they would be within rights to do so, so I
don't do it. I'd suggest you talk to your lawyer whether it's worth
taking the risk for you.
