IF you spent $$ developing the graphics and someone else 'borrowed'
them for free and essentially made money or enhanced their App with
your work, do you think they could be in trouble if you, the owner of
such materials, would decide to chase them?
Another check may be to go into the app's box, and see if there's
some sort of copyright. Statements like "Copyright ©XXXX Some
Company, Inc., All Rights Reserved." should be some sort of warning.
Now, if the image is part of API (common control), and documented
as part of the API, its use is probably OK. So if there's a named
image in some framework, or that image can be retrieved via API from
the framework and that image can be loaded as part of API calls
from their correct locations in the library for which you have been
granted use rights, then you might be OK.
But then again, I am not a lawyer. I would encourage you to hire a
lawyer to review the acceptable use policies. This may be useful in
case you get sued, and need to retain such lawyer to help you with
the litigation. From your question, I would think you may want to
retain them so you are not surprised and discomforted later when the
the cease and desist notice arrives at your mailbox.
