SVR shouldn't be interfering with the operation of your program. If it is then there is likely: 1) a bug in your progrem 2) a bug in the OS

If it's the former, fix it :)
If it's the latter, file a bug with Apple.

So any ideas on how to detect if the user has enable the secure
virtual memory option in the security pref pane

PS. I assume its stored in a plist somewhere...
