Perhaps you could refrain from giving incorrect legal advice on the cocoa-dev mailing list?
The material covered by an NDA is generally regarded as a trade secret; many jurisdictions have explicit trade secret legislation, and even those that don't may allow prosecution of *recipients* of trade secrets for receiving stolen goods (or similar).
If you want to know how that affects you, you should consult a qualified lawyer.
In any event, cocoa-dev is run by Apple. Even without the NDA, Apple is well within its rights to insist that some things can't be discussed here, and arguing with the moderator will just mean that you're moderated or eventually banned from the list (and maybe *all* of Apple's lists, in extreme cases) altogether.
