You are referring to particular software vendors claims, not all.
There is profile creation software that doesn't claim copyright
over profiles it produces. Such profiles are the properties of
the person who created them, and can be distributed as they
see fit.
Personally I wonder if the vendors claims of copyright on profiles
would hold any water in a court of law. Who is the author of the
profile ? It can't be the profiling software, since it isn't
a legal entity, and only legal entities can own things.
It can't be the author of the profiling software, because if
they were the authors of all profiles that come out of their
software, then they could of course prove this by being able
to supply said profile before it has been made by the
user of the software. This is clearly impossible, so the
unique nature of each profiles must be something provided
by the end user, proving that they are the primary author.
The software vendors might claim that certain portions of
the profile are their copyright (ie. the unique strings and
binary sequences that were originally written by them, and copied
into each profile), but in this case, simply reading in such a
profile, copying the raw profile data to another profile
(generated by software that doesn't claim copyright of the
strings and binary sequences that it adds to the profile), will
separate the authors works, allowing the resulting profile
to be used as the profile creator sees fit.
