Yes it does.
"(i) Such Licensed Profile is for personal use by such third party only on a specific input, display or output device owned by the third party for which the Licensed Profile was created;
(ii) Your profiling services are conducted on-site for the third party (i.e., physically at the third party’s facility) and not using any other method or communication technique, including but not limited to, Internet-based communications and/or services; and
(iii) The maximum number of Licensed Profiles provided to all third parties by You pursuant to this Agreement within a given calendar year does not exceed fifty (50) Licensed Profiles..."
Line number iii is new. If it's a mistake, it needs to be removed. As long as it's included, I won't be buying this software.
Further, there's also this:
"If the Software is an upgrade of an X-Rite product, then You now may use that upgraded product only in accordance with this Agreement."
And as I read that, that means that if I upgrade my MonacoProfiler to i1P, then I tossed out its EULA in the doing.
I can assure you that ain't happening.
Now, maybe this is all a big misunderstanding, but the fact is this language is pretty clear, and seems pretty intentional to me. And by this language they are indeed restricting consultants from making (more than fifty a year) custom profiles for individual customers for a fee. If it's all a big misunderstanding that's fine. Just as soon as they clear it up, I'll give some consideration to purchasing their product.
