Yes, they like to claim that. It may not be legally enforceable though. Such EULA's
1) May not be valid, because you haven't negotiated or signed a contract (this
probably depends on case law in your jurisdiction).
2) May contravene statutory rights.
There is a long legal history supporting the first sale doctrine, and it hasn't been completely
abandoned yet, although it's much clearer when you have a physical copy. See
