By "unload" you mean "close the GUI" or "remove the AU from the effects slot"?

Obviously some object(s) inside your AU seem to survive unloading,
otherwise you wouldn't be seeing that error when trying to create a
new instance. Try implementing -release in your AU class to see if it
is being called.
