Volume being "remembered" in my session?

This is on iOS 4.2 on an iPhone 3G with headphones plugged in.

I have a PlayAndRecord session in my app with OverrideCategoryMixWithOthers set.

Here's the steps I'm following:
I have music playing at 100% volume, and I launch my application, the music continues playing at full volume.
I push the home button, my application is minimized, I lower the volume to 50% using the hardware buttons.
I then resume my application and the volume suddenly jumps to 100% again.

It seems like my session is somehow remembering the volume setting?  How can I obey the user's desired volume setting in this case?

Also, this is only happening with my headphones plugged in (does not happen if outputting to the speaker).

Has anyone experienced this before?
