I've had problems with Time Machine failing with -41 and even finder copy started having problems.  I finally figured out the cause, it was funky (either corrupted or strange) ACLs.  I stripped all the ACLs from my home directory (chmod -R -N ~) and that's made the problem go away.

But it appears that some setting I have somewhere on OS X Server sharepoints occasionally re-introduces the problem ACL settings.
