Regardless of if you consider it an upgrade, Installer does consider it an upgrade. As best I can tell it only reads receipts on the boot volume, regardless of what you specify as the destination volume. Thus conditions like allow relocation only work on the boot volume, regardless of where you are actually installing the software.
Additionally, requirements, both for component packages as well as distribution (aka "flat meta" packages), can also be set to reference boot volume or destination volume.
