Ethernet 1 port no longer going in PROMISC mode. Help!

Happy holidays!

I have a xServe intel box whose ethernet port refuses to go into promiscuous mode. I have tried tcpdump and my own program. I know it is not going into promiscuous mode in the fact that it is not passing unicast traffic. It's twin port has no problem.

When I had the box at my business it was not a problem and then I shipped it to the customer and this problem showed up. When I run my program or tcpdump the ifconfig shows that it is not in PROMISC mode. This is port en0. En1 has no problem when I use it.

These are the ethernet ports on the motherboard.

The xServe is running 10.5.1 server.

Anybody have a clue on how to get it back to PROMISC mode?
