I'm missing what's your issue. What you want to achieve and what's the blocker?
The driver can define (in plist personality) if the dialog should aper or not at all. It's relatively new feature. If driver defines nothing special system attempts to create new service unless ANY service (perhaps even removed service) linked to the same network interface exists.... more or less this is all what's happening.
how your needs fit to this?

Been quite a while since I had to mess with this but it is (or can be) controlled by the device driver. Have a look at the open source prolific pl2303 driver. There is some code in there that controls this behavior.

If the user cancels, no service is created.
If the user goes to network system prefs and clicks apply, the new service is created and active.
If a new location is created and then the device re-inserted, the dialog is not seen again and the service for the device is not automatically created. The user has to know to go to network system prefs and create a new service.
What controls if the OS displays this dialog or not?
