Erik, thanks for the important clarification!
What I failed to mention is that I assumed all devices are assigned at deploy.apple.com and have a enrollment configuration provided by your MDM for non-removable enrollment and wireless supervision.
Given the above:
- When restoring a backup to a different device, DEP enrollment settings will always be applied. - When restoring a backup to the same device, MDM enrollment and supervision will come from the backup.
So, if supporting backups AND providing non-removable MDM and wireless supervision are the goals, be sure to capture your backup on a device with non-removable MDM and wireless supervision to prevent the "old" enrollment (presumably removable, if it exists) and supervision (presumably from Configurator, if it exists) from being applied.

My experience has been different than what Mike has described. If you back up on an iPad with a DEP-provided supervision profile installed and go to the same device, it will restore properly. If you go to a different device, I've never seen profiles restore as part of the iCloud or iTunes restore process. However, they'll install fresh as part of the DEP process if you have the new device in DEP.
In terms of the question about backing up a device already in DEP and restoring to the same device, that has been fine in my experience. All profiles come back properly. The only real gotcha is that if you restore from a pre-DEP backup, it won't go through the DEP screens at all - the iPad doesn't even know the MDM server exists.
