This is a legal requirement which cannot be enforced in software. The
war or ear packaging requires that you include the license key in the
package. There is no mechanism to reinstall the key after the package
is compiled. If you build an ear you can install it on a machine that
do not have WO installed. That does not mean you should not buy a
license ($300) for each copy you sell but as for including the actual
license key Apple does not provide any mechanism for that.
I asked for the "official" position from Apple a few month ago and
never got an answer. Where it gets really murky is that if you sell a
license for a MacOSX server you don't need to pay for for all other
platform including MacOSX client you need to buy a valid license you
just cannot include the number within the package.
