I think you're referring to behaviour oft called 'Focus follows mouse', as oppose
to the currently implemented 'click to focus'.
The usual argument against this is that, when you move the mouse out of a window, you lose focus
from that app, and the desktop gets focus. This causes the top menu to change from that of the
application to that of the desktop. The net result is that you can never access the menu of an
application (unless the window is butted up to the menu at the top of the screen).
Of course, Apple could always give the user the option to put the menus at the top of the windows,
like other windowing systems. This would leave the bar at the top of the screen available for
status info, as it is currently.
This would have the added effect of making multiple-screen implementations much more useful.
Currently, if you have two monitors on your computer (and they're not mirrored), the menu is
only displayed on one of the screens. This results in exhaustive cursor moving, when accessing
menus for an application on the screen that doesn't have the menu on it.
Something I would also like to see with the above, is the ability to provide input to
windows that are not at the front of the window stack.
I, personally, don't really see much technical argument against having an option putting the
menus in the windows, but I do see that it would take some effort and so is a business
decision Apple would have to make. Note, however, that, IINM, even Microsoft allow their window
manager to be 'adjusted' to have this behaviour (never tried it though).
