I have verified the behavior you mention above and the only work around
I have found is to move them so they do not overlap then select the one
you want by clicking in an area of no overlap. This works for my setup.
Of course with expose you can have as many xterms as you like
overlapped on one desktop and select the one you by hitting F9.
