shell script build phase creating error

I'm trying to use a copy files build phase to copy a framework into the frameworks directory of my target. Then using CP I copy the built target to a specific folder on disk. It works once, then if I try to do it again without removing the build directory, I get an error that cp cannot overwrite a directory with a non-directory when both are symbolic links.

Is there anyway around this?
