Actually this has been the case with iPhone/iPad software purchased
from the AppStore and it looks like the same for the MacStore too.
According to the license you are not allowed to use any software
purchased from these sources commercially - but there's more! When
you buy something from one of these outlets, you do not get a VAT
invoice by default. In Europe (the store is registered in
Luxembourg), business to business transactions are supposed to be VAT
free (if you request it and provide your VAT number) . When I
complained about this, I was referred to the license agreement that
said I couldn't use it commercially and so therefore they didn't need
to provide a VAT invoice. In fact they *are* obliged to provide one
and will do so if you get through to the right department, however
there is no way to get the VAT back as far as I can tell.
I mention this here, since maybe this is the reason for the clause in
the license. I can't think that it does Apple any good to not charge
the VAT, since they have to pay it to the government anyway.
