Yep. Go ahead and file a bug asking for a "don't create" parameter of
some sort, if you like.
....There is a difference, however. OHM, if he moves one of the
undesirably created folders to the trash, then runs the script
again, the result is an alias which points to the item in the trash
(with no additional creation.)
OMM, OS9.1, moving the item to the trash and running the script
creates another new item, disregarding the one in the trash.
I think this is a bug in the OS X Finder.
The Finder has its problems, but this isn't one of them -- the culprit
here is FindFolder itself. Essentially, once you ask FindFolder where
something is, it will remember *that specific folder* until you log
out, even if you move or rename it. File a bug -- be sure to mention
that Mac OS 9 didn't do that, since that helps your case.
