From what I can see the problem is associated with the "delay" and the "giving up after " timeouts being linked..
if the "giving up after" time is increased to 9 seconds instead of 4, the desired result (4 seconds of dialog window) is achieved..
set numDelay to 5 delay numDelay display alert "My Dialog " giving up after numDelay + 4
