AFAICT, that hasn't been true since at least 10.4, probably earlier.  The OS X versions of cp, mv, etc. preserve metadata, resource forks, etc.

My recent experience is that ...

do shell script "cp -np " & sourcePath & space & targetPath

does NOT preserve comments. I have to write the comment of the source file to the new file, via tell Finder, whenever I use this.
