If people or companies want to help us we want them to know that,
even though
we are a not-for-profit corporation, their donation or contribution
isn't to
a charity. They cannot deduct their largesse off their taxes.
Vendors will
often send something, be it SWAG or software & hardware, but this
isn't a sure
thing.
Any donation from a business is deductible to the business as a
business expense.
For IRS purposes, only 501(C)(3) organizations qualify for charitable
gifts and they must be registered with the IRS and provide their ID
number.
The Pennsylvania Attorney General polices the charity scene here. In
Pennsylvania you only put in a legal notice if you are a registered
charity. However, public service organizations and charitable
organizations raising less than $25,000 annually are not required to
register with the Attorney General if they do not pay anyone to raise
funds on their behalf.
However, as a tax-exempt organization in Pennsylvania, we can only
hold three or less fund raisers of any kind each year or else we have
to charge sales tax. We sometimes have auctions and also sell club
CDs. We must limit such events to three a year.
