Why is this considered "off-limits" to third party developers?

Is it simply a space issue? I've noticed that with some apps the two different sets of menus (the app's menus on the left and the menu extras on the right) overlap and that causes some issues. (unless of course you've got a nice 22" cinema display, or a TiBook)

You can't. Those are off-limits to third party developers. Some of the older hacks used transparent windows which sat above the menu bar but I'd strongly suggest using application dock menus instead.
