It's illegal only if it's done without the copyright holder's
permission; many smaller, unsigned bands have given such permission
in hopes of promoting their live shows and building a fan base.
Not just many - tens of thousands. More independent artists have
their works on p2p networks than 'commercialized' one. Mass-Media
blindness, however, prevents a lot of people from seeing past the p2p
piracy stigma.
Returning to the topic at hand, if the original soulseek/OSX author
wants to find someone to take over the project, they should contact
me privately.
I know a few people who would be more than happy to help assist in
such a valuable activity for the sake of art.
