That's an illogical conclusion you've come to. One could also use it to
easily download perfectly legal MP3s that are being distributed with the
copyright holder's blessing.
Downloading copyrighted music is, of course, both illegal and immoral.
It's illegal only if it's done without the copyright holder's
permission; many smaller, unsigned bands have given such permission in
hopes of promoting their live shows and building a fan base.
Whether or not it's also immoral is a judgment call.
Certainly, if money changes hands, then the copyright holder is entitled
to a royalty payment. The grey area to me is, are they entitled to
specify how much money must change hands, or what formats the music is
available in, or where it may be sold? In a free market, the value of a
thing is determined not by the seller alone, but is instead a function
of supply vs. demand. Do copyright holders have the right to
artificially restrict the supply of what they sell, in order to inflate
its price?
What's more, what about the immense number of older recordings that are
no longer available anywhere, in any format, for any price? If the
copyright holder is not willing to sell me a legal copy, what then?
