Get a lawyer.
I'm currently working on a case where a smart but somewhat whacko layperson
drafted his own real estate transaction documents. What a mess! They don't
even come close to accomplishing what he wanted, and it's costing him a lot
more money than it would have if he'd hired a lawyer in the first place.
There are lots of perfectly reasonable draft licenses floating around, but,
as I've said, you have to be careful to read them before you use them. But
I'm confident that you won't find a ready-made form that excludes any
company "deemed by the code's author to be an anti-competitive monopoly."
Mostly for the reason I gave before: no company in its right mind would use
code that was subject to your whim.
As to what is and what isn't "pretty damn obvious to everyone," there's no
such thing in the law. Congress has tried to define monopoly in iron-clad
fashion for about 100 years, and still there are companies who spend a lot
of money arguing about it in court. I won't name any names....
I'll also stop responding now. I meant my first post simply to bring the
Creative Commons licenses to everybody's attention, since they are in many
respects much simpler than the usual alternatives.
