is the NSMenu object returned by the NSApplication method mainMenu the menubar?

No.

If mainMenu is NOT the menubar, is it the "Apple" menu or the next one - the one that has the application's name?

The main menu consists of all left hand menu items in the menubar.

The menubar is the whole bar at the top of the screen. It hosts the main menu on the left and menu extras and status items on the right hand side.
