So I am unable to establish the history of the files so I don't want to limit the colours anymore by restricting the space further still. So I am still unclear to what I should do.
The suggestion of using an effective RGB working space still holds.. .for new files.
If you receive a file in CMYK then it is in SOME flavor of CMYK and the profile to be used is the one that created the CMYK - at least in theory. So if you get a file from a customer in CMYK they have already thrown out any extra-SWOP colors by choosing Mode->Convert->CMYK with the default Photoshop setup of the SWOP profile. Ok I'm assuming things here by suggesting this particular conversion but I still think it'll hold true for 80% of the CMYK floating around out there...
So, you can choose a "larger" CMYK space but you will be artificially enhancing the color in the file. That doesn't mean your clients won't like it though...
