I think that is probably better answered by the overall Jack team
(not our specific OS X Jack development team). You can contact
that team at http://jackit.sourceforge.net .
At a high level, Jack is a combination of GPL and LGPL, and so I
do not think you will have a problem if using Jack as a part of
commercial software.
