There was no check box or NDA agreement. Just a two page survey with
an "I agree" button at the bottom when I downloaded the corrupted SDK
image yesterday.
Also, ADC was thoroughly borked yesterday. After going to the iPhone
page, ADC would redirect people to an internal-only Apple domain, one
that is not accessible to the outside world. The "I agree" button
redirected me to this internal-only Apple domain name. This meant
external losers like me had to do some crazy things to get the SDK
(since the "follow the links" way never could have worked). And I was
getting 404's on some old links at one time, then reloading would
remove the 404. (These 404's occurred with old and new Mac OS X
documentation).
ADC still seems to be borked a bit today. But not nearly as bad as
yesterday.

You had to check a check box under a fairly long nondisclosure
agreement, which said, in part, that you would not discuss the
disclosed material outside of your own organization.
