I don't know about FileMerge in specific, but Apple's policy on Open Sourcing has always been that we don't use Open Source as a dumping ground for projects that we are not actively supporting and working on. We only Open Source projects we actually want to work to develop a community around.

Additionally, please keep in mind that FileMerge is often used for outside-of-SCM operations. Until Xcode can replace every use of FileMerge, we still need it.
