IANAL, and neither do I play one on TV, but I don't see why that would be the case. I would believe that the logic is reverse here: "If you are using the software commercially, then you are a company in this sense"


The interesting bit is, that this discussion never reached me before Xcode 4. Did people not notice, or did they really think that you could not use Pages, Numbers and other iOS and Mac Software commercially?

I think the statement from Apple is very clear, and needs no further discussion. Again, yes, the VAT thing sucks bad.

The point I'm trying to make is that AFAIK when you setup your AppStore account if you register as a *Personal* user then you are bound by the rules for personal use. If you register as a business user and enter your VAT number (even though you don't get the VAT back) then you are bound by the commercial rules. The problem that hit me was that I don't think there was a business option when I first registered at he AppStore (shortly after it opened), so many people on this list should maybe re-register as a business if there are using the software on a commercial basis. However, legally I'm not sure if you can transfer the license from the personal account to the business account.


I guess it's the wording that maybe causing some confusion too, e.g.

(i) You may download and use an application from the Mac App Store (“Mac App Store Product”) for personal, non-commercial use on any Apple-branded products running Mac OS X (“Mac Computer”) that you own or control.

Does this mean you can't use the Application you have just brought itself commercially (e.g. rent out or otherwise make money on the App itself) or does it mean you can't use in your own business (e.g. use it to do your accounts or write a letter for your business). Or does it mean both?
