IANAL, and neither do I play one on TV, but I don't see why that would be the case. I would believe that the logic is reverse here: "If you are using the software commercially, then you are a company in this sense"

The interesting bit is, that this discussion never reached me before Xcode 4. Did people not notice, or did they really think that you could not use Pages, Numbers and other iOS and Mac Software commercially?

I think the statement from Apple is very clear, and needs no further discussion. Again, yes, the VAT thing sucks bad.
