Yeah, I would check these things:
1. The user is on Lion.
2. "Enable access for assistive devices" is off.
That is (I believe) the case where you would need to put up the dialog.
Maybe when your script is run, you do this in a "pre flight check" and instruct them to perform the action, or your script can do it but it will require a password.
Something like "This script requires that "Enable access for assistive devices" is enabled in the Universal Access panel of System Preferences. Please check this button and click continue."
And you can either wait for them to do it on their own, or you can tell System Preferences to open to the proper panel and wait for them to check the button and click continue.
I know that neither option is ideal. I'm just trying to come up with the least bad solution.
