It's not always *static*. For example, depending on which developer program you are in, you might have access to a newer version of Xcode that has access to beta software and hence beta documentation, which should not be accessible to other users.
There are also issues to do with user permissions that come into play when installing stuff into /Library as opposed to ~/Library.

And it can, as has already been mentioned here. It just doesn't do it by default.
