I don't recall seeing that error message. I suspect you would have
checked this, but does the number of swatches in the combined
measurement file match that of the reference file? When creating a
reference file for a custom chart by hand it can be easy enough to miss
out a swatch. BTW if you are not already aware GretagMacbeth's ColorLab
application is very useful for creating testchart images from reference
files and vice versa. They don't offer end user support for it, but it's
very useful. It's use is described in the book "Real World Color
Management" and the app itself can be downloaded from the ProfileMaker
section of the GretagMacbeth website.

I don't know what limit there is on the number of patches.
