Well, these are good reasons as to why they don't HAVE to make it available.
Clearly you have given more than enough support for this argument
(right down to the spam attached as a license agreement -- and you
use bandwidth as an argument...!).
My question though is why SHOULDn't it be available? I don't see
this anywhere.
Is this too confusing? Perhaps I should ask someone who is not a
professional in the field of computer support....

Dave, I'm sorry, why did you say Apple should not allow use of the
Beta version?
1. Because it is their product.
2. Because it is beta.
3. Because they are under no obligation to do so.
4. Because they never promised it.
5. Because it will not be updated and will, because of this, may
cause significant problems in the future.
6. And most importantly, because of the license agreement (attached,
in part, below for everyone as a reminder) with every single X11 0.3
Beta install, which makes it plain as day.
