The new location was only introduced in OS X 10.8, and is designed for Scripts menus (or panels) that belong to sandboxed apps. I wouldn't be surprised if the System-level Scripts menu adopted the same folder at some stage, for the sake of uniformity, but at present they are separate.
In fact, I only know of one app that actually uses the new location at this stage, and I wrote it. But that's probably a more a reflection of the fact that I can't think of any sandboxed apps that have their own Scripts menus, and therefore *need* to use it.
