I don't have problems with clicking and holding down the button while
lifting the mighty mouse, but to do so, I had to disable button 4
because it would get activated whenever I did that.
On the other hand, people always seem to be happiest with whatever
works for them (as seems to be born out by this email thread). In my
case, I'm quite satisfied with the might mouse after I turned off
button 4.

I have two nonfunctional "Mighty Mice" and a third starting to
turn; the inability to clean that mini-trackball is a killer. I'm
replacing them with Logitech laptop mice as they fail, because I
find the smaller size easier to use.
